Taxpayer choked to unconsciousness in Finanças office by off-duty GNR officer

financaslogoThe GNR has announced an immediate internal inquiry after a taxpayer was rendered unconscious at a Finanças office.

The incident happened in Montijo just south of Lisbon when a Brazilian is alleged to have been offensive to tax officials, something he denies.

An off-duty GNR officer decided to grab the man around the neck, a violent action that was filmed and posted live on Facebook.

Police said that they have decided to investigate the matter further “based on the resulting footage,” which shows the customer being choked until he is rendered unconscious.

The GNR’s Independent Socio-Professional Association is to carry out an "unbiased investigation."

The customer was trying to get answers from Finanças staff to his questions and was filming the interaction for his Facebook page.

"The GNR confirms the detention of a citizen who had an improper and offensive attitude towards the employees of the Finanças office in Montijo," according to a GNR statement which appears to prejudge the events that led to the man’s incapacitation.

The GNR added that in view of the circumstances witnessed in the images, it was decided to "investigate the circumstances of the citizen's arrest, in order to determine any responsibilities."

"We hope that the alleged assaults on a Brazilian citizen by a GNR officer in the Montijo Finanças office will be investigated without prejudice and according to the interpretation of the law," read the statement issued to news agency, Lusa, by the Independent Socio-Professional Association.

The association maintains also that GNR officers, in uniform or off-duty, are "obliged to resort to the use of force when it proves to be legitimate, necessary, adequate and proportional to the objective."

"The association hopes that the act allegedly committed by the officer has not exceeded the legal limits and that the officer’s conduct, given his determination to enforce the rights of citizens, deserves public praise."

This evening the Public Prosecutor's Office issued a statement confirming it is to investigate the events which led to the GNR officer 'detaining a man in the Finanças office.'

The Minister of Internal Administration has asked the General Inspectorate of Internal Administration to open an investigation into the circumstances.

Looks like a case of assault and battery using excessive force. Video clearly shows Brazilian gentleman did not resist and held on to the counter as long as he could. Certainly something I would not expect in Europe. Wonder if the country of origin played a role in the attack...

But a member of the public is not allowed to question his tax or take photographs inside a Financas office. The fact is that far too many GNR officers are thugs.

Nothing will happen about this as they will close ranks as the army always does.

Time and again in Portugal it is only through the (illegal) use of Facebook and similar social media that we ever get to hear of these incidents. The Brazilian must have known from previous experience he would be fobbed off by the Financas staff so wanted proof. Illegal in that Financas were not aware they were being recorded so got agitated and triggered off Ferroman. In similar situations, i.e. knowing we will be fobbed off when making reasonable queries - we must all now be doing simultaneous live recording and broadcasting. This is all that saved the Brazilian from the serious charge of attacking the GNR Ferroman.

Also has anyone got any history on the GNR’s Independent Socio-Professional Association ? Independent !!! Independent !!! Left in the English language, without translation, this must win an award for its misuse !

Why not ask the man to leave the Finanças office if he was being upset (which I doubt he was).

If the GNR goon had identified himself and said 'please leave or I will arrest you' any fool would get the picture and leave.

Let's see what the GNR have to report when they have investigated themselfs

This is absolutely incredible. When I watched the video I was almost in tears. That man was doing nothing wrong, just sharing his story on facebook. The GNR officer should be fired and disciplined. This is not a police state! If we go out and make our opinions known, do we have to fear being CHOKED until we pass out by an off duty GNR officer who has watched too many Marvel movies? Makes me want to move out of Portugal!
