Scammed BES depositors to take individual court action

besAlthough collectively in agreement, each overseas BES depositor ripped off by Ricardo Salgado’s last-ditch attempt to save Grupo Espírito Santo, is to mount an individual court action.

Hundreds of overseas customers that ended up with their savings invested in risky commercial paper instead of BES deposits will go to court to demand the annulment of the investment and for their money back.

According to Luís Marques who heads the overseas action group, there was a meeting on Tuesday between hundreds of BES customers living outside of Portugal who consider themselves to have been tricked by BES, and in the end there was a unanimous decision to bring individual cases to court, citing the Bank of Portugal and if necessary individual BES branch manager as the responsible parties.

Marques, the lawyer representing 420 overseas BES customers, said that his clients will go to court to recover all the money and in the event of a partial solution being accepted by his clients, each will continue with court proceedings until they recover the entire amount that was switched from bank deposits into commercial paper and then vanished.

"Those affected will not accept any loss. Therefore, if there is partial settlement of their claims – whether by Fosun or by any other entity – we will require the remaining compensation from the Portuguese state."

Any mention of Portuguese bank regulation keeps reminding us that the whole principle of 'regulation' and 'monitoring' have been entirely absent from Portuguese public or private life. It is as though the concept never existed and never translated into this countries language.

Did whoever coin the phrase 'race blind' during Salazar's time - thereby in theory allowing the Portuguese state to not classify or treat anyone differently due to race, ethnicity etc but actually meant the opposite. Allowing the authorities to penalise minorities but no records exist to prove it was done - then also bundle in 'regulation blind'?

The result today meaning Portugal is so desperately behind the more advanced countries. Having totally failed to effectively manage incoming EU member state citizens and just robbing and cheating them endlessly Portugal is now staring at an incoming tide of migrant non EU foreigners of different races and ethnicity. All entitled to specific care as directed by Brussels to take account for their differing origins.

Presumably then this idiotic sham of 'race blindness' will now be consigned to history where it should have gone 30 years ago ! And just maybe we can hope that 'regulation' and 'monitoring' will begin to be taught within University courses and on public sector re-training schemes. Then Brussels must wait a few more generations for the improvements to trickle through.
