New national register of rental properties in Portugal

rentalvillaSoon, properties for let will have to be registered on a national database held by Turismo de Portugal, according to the Ministry of Economy, as part of a tightening up of regulations for local accommodation.

Apartments and houses rented to tourists for short periods of time have to register with Tourism of Portugal as local accommodation, according to a ministry spokesman.

The Secretary of State for Tourism commented today that the register will hold details of all rental properties for tourists as properties have proliferated on websites and he claims that the idea is not to "prohibit or impede the local rental market," adding that this is "a product that has its place in the market and must compete with other accommodation types."

"The regulation of local accommodation is being reviewed," confirmed the ministry, stressing that this revision respects "the principles that have guided the legislative changes in the tourism sector that the Government has already approved i.e. less bureaucracy and freedom of initiative."

There already is a Alojamento Local registration scheme run by local councils for rental accommodation but a large number of homes continue completely to evade the control of the authorities. This has meant that not only are properties not registered, but owners also do not pay taxes, VAT, IRS or IRC, depending on whether properties are owned by individuals or companies and their level of turnover.

For owners who do not comply there will be sharp increases in fines and other sanctions, and now the possibility of immediate closure for non-compliance. Fines of ‘many thousands of euros’ are to be put in  place for those continuing to flout the law.
 
The new National Register of Local Accommodation aims somehow to reduce bureaucracy and to force property owners who rent to tourists for short periods of time to register their houses and to meet a number of requirements.

The underlying reason is to combat tax evasion and unfair competition which penalises fully compliant tourist developments.

Inspections already have begun by searching for listings on the Internet and monitoring is being strengthened, soon with added links between the Tourism of Portugal register and the Tax Authority.

The new requirements include the obligation of mounting a sign on the door of the property and having a complaints book but many properties will not be able to comply with other rules and regulations which is one of the reasons owners have not registered.

Income tax is illegal, so is property tax. You know who charge income and property tax? The government and the mafia. Both are fierce competitors for your "tax" buck. When mafia person is imprisoned, this means that government has eliminated yet another competitor to themselves.

Why would someone want to rent out their apartment attached to their house if the rents are so low just 150-200€ per month.They may as well just keep those premises for relatives, friends and visiting family guests. I remember having to pay 250€ electricity on apartment that rented out for 150€, an absurdly loss.

I had a good laugh when I went to local Finanças office and asked I wanted to register an internet business (making about 300-600€ per month, but perhaps more in the future). The Chief (his assistant was making jokes saying "do not bother") told me he has no idea how to register me, yet they are the only place I need to go to to get my biz registered. So he told me if I don't make much (did not mention how much or how little is that) I should not worry and just go home and relax, and his assistant told me a few jokes to lead me out. This is the reason why people are moving to Portugal, because they don't care if you do your small business under a table, unregistered. No, they encourage that., And that is how it should be in a truly free society. Gladly i am not paying to import all the millions illegal economic "refugees" plus all believing the medieval death cult, that will kill and outnumber us all in the longer run.

Dear Ana, can you tell me how to earn "thousands of rental income", since I only have losses and cannot raise the rent because no one wants to hire my property anymore!

No problem with getting a license if I earned more per year than the license and all the other paperwork is going to cost me. I only rent for 4 weeks a year to help me with the running costs. Add running costs, gas, electric, rental license and tax together and I'm in negative balance. I, like many others will just stop renting out, playing into the hands of the big boys who just want us out of business.

What would happen if the rental guests are not known to you and either refuse to provide tax codes or give you false information? I agree, it's the thin edge of the wedge and while I concur that owners should pay tax on the income generated, some will stop doing this and then tourism as a whole (and the income that the Portuguese government enjoy) will reduce when people start looking elsewhere to holiday.

I totally agree that properties should be registered and people should pay taxes, but in practice we have found this very difficult. We have a small property and have complied with everything, fire certificates, energy certificate, gas and electricity certificate. All these had to presented with an electronic signature of the technician concerned. Even the application form had to have an electronic signature, which can only be obtained by someone with a citizen's card, which as tax residents to Portugal, we are not entitled to, so we had to pay someone to do it and get a power of attorney for that person at the notary. Getting all the bits and bobs together took three months. After the application has been in for two months, we still haven't received our licence. We have paid nearly 1000 euros for all these certificates etc. We are trying to be legal and pay our taxes. We can't get a complaints book without a licence, so if we try to rent, we could be be fined. Change is needed!

Official apartments and hotels have had to registered and be inspected for years. All that is happening is long overdue. What is wrong with a level playing field.?
All property managers should be registered and be made responsible for the license and declaration of income. The new laws are long overdue.

Fully agree with both John H and Ana P above. Further, why should we have to pay the exorbitant taxes and those who are renting, hiring etc and are probably absent from this country be exempt. Illegal cars next boys / you know the ones: MOT and insurance from UK which renders the drivers and vehicles totally illegal for those living in this country. Have a bang and the third party victim left being hit by an uninsured driver. Prison and vehicle to crushing machine the only answer. Any agreements: all legals should be agreeing!

This obsession for records and NIF numbers is symptomatic of a state machine that does not trust its citizens, so creates more and more bizarre ways of tracking them and trying to catch them out with form filling bureaucracy. The involvement now of Turismo de Portugal adds yet another senseless level of form filling for zero purpose but to amass more names and numbers so the tax office can send out increasingly inaccurate tax demands. Yes, dental records will be next....
