Autódromo Internacional do Algarve’s owner Parkalgar submitted a last ditch proposal to the Portimão court on 15 June, 2012 to stave off bankruptcy and ruin.
Its Special Revitalization Plan offers the payment of close to 100% of its debt to bankers BCP, a reduction in running costs of €350,000 per year and an eventual payout to unsecured creditors of just 30% of what they are owed.
BCP is asked to forgive interest and fines of €23 million by the Autódromo Internacional do Algarve. The proposal relies heavily on handing out property in lieu of money owed, including unfinished apartments and plots of land. It also promises an "extraordinary input of funds amounting to €10 million."
This plan has been devised by Parkalgar and a provisional liquidator, and seeks to remodel the company in order to "ensure the interest and satisfaction of its creditors," according to circuit boss Paulo Pinheiro.
The proposed recovery plan hopes to access the government Revitalising program, which has on offer a total of €220 million to troubled Portuguese companies. The use of the Revitalising procedure for Parkalgar was enabled by the earlier agreement of two major creditors, BCP and Bemposta.
According to the plan an injection of € 10 million in the company will enable the resumption of construction of the real estate part of the project, apartments and a hotel. It is not clear where this money is coming from.
The plan forecasts a turnover of €10.1 million for activity on the tracks, and €13.5 million from the sale of apartments which need to be finished, also the hotel needs to be finished and opened. The plan relies on selling on-track apartments in the worst property market the Algarve has witnessed in living memory.
The second part of the plan relies on major creditors forgiving monies owed including "pardons on total interest and damages claimed." The debt forgiveness is suggested for unsecured creditors in a 70% haircut, lowering the total owed by this group from €23.5 million to €7 million.The remaining €160.7million in debt and interest is to be ‘restructured.’
All of this is unlikely to impress Bernie Ecclestone, the Formula 1 boss, whose company presented an action to get his its back, some €3.2 million.
BCP are owed €117.4million. According to the figures put forward, the bank should see this figure reduced to €94.3 million if it agrees to the plan.
The total indebtedness of the whole financial disaster comes down from €160million to around €120 million with repayment terms stretched into the distant future. "We also introduced grace periods for repayment on some claims," according to the proposal, meaning that they will decide not to pay some creditors anything until they want to.
Add to all of this the money owed to social security and Finanças and you get a feel for the problem - suppliers contracted with no hope of ever being paid, banks persuaded this was a good use of its depositors’ money and a half finished property portfolio that no one really wants.
The proposals to the state are to pay the social security debt in 150 monthly payments, and Finanças over 120 months.
The plan points to "the reduction of fixed costs and salaries" of €350,000 per year.
The failure of the Irish Harte Group Holdings, the company that had paid a deposit and signed a promissory contract in 2009 for the apartments and hotel land, left Parkalgar in a difficult situation. The company has been unable to replace the budgeted income from this deal, despite retaining the advanced money.
Pinheiro informed creditors that if they want to join the group of lenders who approve the plan, they can respond in writing. If they do not want to, a ‘no’ vote must be sent to the court.
Presented by the Mayor of Portimão, and supported by Portimão ratepayers, as "one of the biggest projects ever undertaken" in the Algarve, as "decisive for the economic and tourism future" of the region, the Autódromo Internacional do Algarve has failed to meet expectations four years after its opening.
The enterprise has cost €200 million, occupies 310 hectares and was presented as the most modern European circuit of its type. Paulo Pinheiro, executive director of Parkalgar, said back then that 'the project would not be a "white elephant", unlike at the Estoril race track.'
The acceptance or rejection of the Special Revitalization Plan is dependent on the trial judge, who has 20 days to rule on whether the ambitious plan is viable, or whether it is just prolonging the financial pain. The company is clearly insolvent and over its head in debt. Even by extending payments of monies owed over 15 years, which will not impress many suppliers, is there any chance of success?
Unconfirmed reports in today's Correio de Manha state that a majority of the creditors agreed to the rescue plan and the judges' report should be a positive one. The choice for suppliers was between writing off the money owed to them and putting it down to a bad experience, or getting small payments over the next fifteen years.
The viability of the rescue plan is another thing entirely and the management will have to perform a series of small miracles to make any headway in the current property market, upon which the success of the plan largely rests.
