Update fine-tunes Local Lodging Law

villaDecree-Law nº63/2015 of 23 April modifies the Local Lodging legislation passed last August. 

While most of the standards remain in place, a few areas have been updated with special emphasis on Hostels.

 

The following measures highlight the principal changes introduced by the new statutes which come into effect in late June.

$    Simplified documentation for Assignment of Activity Operation   

When assigning the Local Lodging business to an Operator, the new rules clarify what type of contracts should be used to legitimise the transfer of responsibility.

$    Information sharing   

The law establishes regular 6-month intervals for information sharing with “AT” (Portuguese Tax Authority) to assure fiscal compliance.

$    Closing a Local Lodging activity     

A maximum period of 60 days is fixed for communicating the closing of the business of a Local Lodging Establishment.

$    Maximum number of units per building    

The new statues allows for the common management of more than 9 apartments per building when these constitute less than 75% of available units in a given edifice.

$    Hostels

According to updated rules, “hostels” are a form of Local Lodging establishment in which the predominant housing unit is a multi-bed dormitory. This Decree-Law regulates the concretion of the system of “hostels”, with new requirements relating to ventilation, lighting and available facilities. Since first introduced 6 months ago, more than 120 hostels have been registered in throughout Portugal.

Conclusion

During the same brief interval, more Local Lodging Establishments have been registered than in the entire period between 2008-2015. The overall objective of the legislation is to regulate and encourage the compliant practice of Local Lodging by providing quality offerings to meet the growing demand for this rapidly expanding form of tourism.
